The New Zealand aviation sector’s climate claims put it at risk of greenwashing litigation with tourism stakeholder reputations on the line, writes Griffith University’s professor of tourism and former head of the University of Otago’s tourism department, James Higham.

On the same day last week that Air New Zealand announced the purchase of its first fully electric aircraft, Christchurch Airport announced it had reached “a new standard for decarbonisation”. On the face of it, great news for reducing aviation emissions in Aotearoa.

The reality is a little more complex – and risky. As the climate warms, so too is the temperature in boardrooms and courtrooms. The aviation industry is under increasing scrutiny for its sustainability claims, and climate litigation is on the rise.

At the same time, “net zero” strategies in general are being challenged. The United Nations High-Level Expert Group was established at last year’s COP27 summit, as Secretary General António Guterres explained, because “net zero suffers from a surplus of confusion and a deficit of credibility”.

The expert group has put forward a set of net-zero guidelines to put a “red line through greenwashing”. The guidelines underpin the UN’s approach to net zero, which requires corporate entities to advance ambitious climate mitigation actions based on rigorous and comprehensive science-based targets.

Among other things, the targets must include emissions reductions from the entity’s full value chain and activities. These include emissions from sources the entity owns and controls directly (known as scope 1); emissions the entity causes indirectly (scope 2); and emissions not produced by the entity itself, but arising up and down its value chain (scope 3).

The expert group also notes that voluntary carbon credits (offsets) cannot be counted towards interim emissions reductions required on the pathway to Net Zero 2050. This is because carbon offsetting has been shown to be troublesome at best, and in many cases a scam.

Airlines in the firing line

Key players in the global aviation industry that make unsupportable claims have become targets for climate litigation.

A recent greenwashing complaint to the European Commission, for example, was filed by consumer groups in 19 countries against 17 airlines. Virgin Atlantic and British Airways are facing formal complaints filed by a climate charity and law firm over sustainable flight claims.

Advertisements for Air France, Lufthansa and Etihad have been banned in the UK for greenwashing, following complaints to the UK Advertising Standards Board that phrases such as “protecting the future”, “sustainable avitaion” and “low-emissions airline” are misleading consumers.

Delta faces a class action lawsuit for claiming to be “the first carbon neutral airline on a global basis” in a case brought by a California resident claiming the airline has grossly misrepresented its climate impact.

And KLM is being sued for greenwashing by law firm Client Earth, which successfully argued the Dutch airline’s “Fly Responsibly” campaign consitutes misleading advertising under EU law while KLM is growing its number of flights rather than reducing emissions.

Long-haul growth versus decarbonisation

Cases like these raise questions about Air New Zealand’s “Flight NZ0strategy and marketing, which focuses on sustainable aviation fuel and next-generation aircraft (including its recently bought electric Beta Alia), complemented by carbon offsetting and operational efficiency.

The focus on sustainable fuel will have to overcome significant scientific, energy, scalability and cost barriers. Solutions to these complex problems are likely to be decades away at least.

While Air New Zealand promotes the Beta Alia – with its inherent altitude, payload and range limitations – it also aims to significantly increase its long haul network, and is setting its sights on the “ultra long haul experience”.

The contradiction between long-haul growth and decarbonisation strategies is expressed in the airline’s own 2017 sustainability report, in which the sustainability advisory panel chair wrote:

“And that’s the dilemma for anyone who cares passionately about addressing the multiple threats of climate change: either stop flying altogether (the logical but somewhat unworldly idealist’s position), or fly as little and as discriminatingly and responsibly as possible (the often uncomfortable pragmatist’s position).”

As consumers and environmentalists focus more on the validity of climate claims and the viability of carbon reduction strategies, Air New Zealand may find it harder to defend its net zero pathway.

Airports on the radar

The environmental claims of other players in the wider aviation system – notably airports – are also likely to attract critical attention.

Airports Council International (ACI) is the global industry body for airports, with over 550 airports taking part in its Airport Carbon Accreditation programme, including many in New Zealand (most recently Invercargill Airport).

Christchurch Airport

Christchurch Airport has been in the program for longer, and makes significant climate claims. In April 2022, it announced “another world class sustainability achievement”, going “beyond carbon neutral, to become climate positive”.

But this doesn’t account for scope 3 emissions, mainly associated with flights in and out of the airport, which make up 95.39% of total emissions. Airports can only appear to be climate-neutral by not accounting for the high and growing emissions of the planes that are their core business.

Stakeholder reputations on the line

Key stakeholders are also exposed to any potential accusations of greenwashing. Christchurch City Council own 75% of the airport through a holding company, and the government owns 25%. Both have declared climate emergencies and made emissions reduction commitments.

Industry groups are involved, too. Tourism Industry Aotearoa, which represents businesses across the tourism industry, last month announced Christchurch Airport the winner of its Tourism Environment Award.

It cited the airport’s “climate positive” status and hailed it as being “at the forefront of airport environmental initiatives globally”. Such claims can be technically true if one accepts the limited parameters used to measure them.

But Tourism Industry Aotearoa will need to ensure its environmental awards keep pace with developments in this rapidly changing field – including the increasing risk of litigation over unsustainable claims about sustainability.

Sustainable aviation fuel is not a silver bullet for the industry if it wants to make a meaningful contribution to addressing the climate challenge, write Susanne Becken and Brendan Mackey of Queensland’s Griffith University and David Simon Lee of Manchester Metropolitan University.

There’s not enough land or renewable energy potential on Earth to produce all the sustainable fuels airlines need.

The global airline industry is fast recovering from the unprecedented pause to flying imposed by Covid-19. In some parts of the world, such as the Middle East, airlines are even expanding rapidly – well beyond pre-pandemic levels.

But how will the industry continue to grow while doing its fair share on climate change? Unless global aviation changes tack, its greenhouse gas emissions are projected to cause about 0.1℃ of total global warming by 2050.

So-called “sustainable aviation fuels” are being promoted by the aviation and energy industries as the preferred solution. These fuels can be made from organic matter such as plants (also known as biomass), waste such as used cooking oil, and synthetic kerosene.

However, as our new research shows, sustainable aviation fuel is not a silver bullet. Even if the industry could make the shift, there’s not enough land or renewable energy potential on Earth to produce all the sustainable fuels airlines need.

A tough ask

In 2021, the International Air Transport Association released a plan for airlines to achieve net-zero carbon by 2050.

Individual airlines have made similar commitments, including American Airlines, Qantas and Air New Zealand.

But there are very few low-carbon alternatives to traditional fossil jet fuel. That makes reducing emissions from the aviation sector extremely difficult.

Two options – batteries and liquid hydrogen – face significant challenges. For example, neither are suitable for long-haul flights. That’s why industry is turning to sustainable aviation fuels.

These fuels effectively perform in the same way as their fossil fuel-derived counterparts. They are suitable for long flights and can be used in existing planes so airlines wouldn’t have to replace whole fleets.

But at the moment, very little sustainable aviation fuel is being produced – and it’s much more expensive than fossil jet fuel.

Sustainable aviation fuel also raises serious environmental concerns. So is the transition actually feasible? Our new research set out to answer this question.

What we found

Our study involved analysing 12 “roadmaps” or plans for decarbonising the global aviation industry. They were published by the industry, outside organisations and academics.

We found the plans rely heavily on biofuels in the medium-term and synthetic e-kerosene in the longer term.

Currently, all sustainable aviation fuels used commercially are produced from food waste such as cooking oil or animal fat. Energy crops (such as soy and willow), agricultural residues (husks, bagasse), and forest biomass (such as logging residue and manufacturing waste) provide larger volumes of raw materials, but chemical engineering processes to turn them into fuel are still developing.

If e-kerosene is to be produced cleanly, it requires electricity produced from renewable energy sources to “split” the water (a process called electrolysis) and produce hydrogen. This hydrogen is then combined with carbon dioxide.

Our research found the roadmaps largely omitted a number of fundamental problems with sustainable aviation fuels.

The first is the huge amount of biomass and clean energy needed. On average across the roadmaps, producing sustainable aviation fuels would require about 9% of global renewable electricity and 30% of available biomass in 2050. Even then, about 30% of fuel used by airlines in 2050 would be fossil-derived.

Other industries also use biomass resources. For example, the cosmetics industry uses tallow in skincare products. Bagasse – the pulp left after sugar cane juice is extracted – is used for heat in sugar mills. So demand for sustainable aviation fuels risks displacing other industries.

Second, the process of converting raw materials into sustainable aviation fuels leads to a major loss of energy, in the form of heat. In the case of e-kerosene, only about 15% of the primary renewable electricity remains to power the aircraft.

Not only is this inefficient, it leaves less clean energy for other industries wanting to decarbonise.

Third, producing sustainable aviation fuels creates greenhouse gas emissions. Growing bio-crops, for instance, requires the use of emissions-intensive fertiliser, harvest machinery and transport.

And already, vast tracts of rainforest are being razed to make way for crops used in biofuels. If sustainable aviation fuels were produced in this way, they’d be considerably worse for the climate than fossil fuels.

Finally, carbon dioxide is not the only aviation emission that contributes to climate change. Others include nitrogen oxides, water vapour and soot. Research to date is inconclusive about whether sustainable aviation fuels will improve this problem.

‘Unrealistic and irresponsible’

The above is not an exhaustive list of the potential climate damage caused by sustainable aviation fuels. But clearly, while the fuels will play a useful role to some extent, the industry’s growth plans are unrealistic and irresponsible.

Private and government investment should instead be directed to lower-carbon forms of transport, such as rail. And for the travelling public, a shift in mindset is required, involving how often and how far we need to travel.

Aviation is not the only industry that must rapidly decarbonise in coming decades. The whole global energy system needs to transition.

That means airlines must not take more than their fair share of finite resources to claim the label of “sustainable”.The Conversation

Cancelled flights, disrupted vacations, and frayed tempers are rife as people take to the skies and the airline industry comes under pressure, writes John Gradek, faculty lecturer and program co-ordinator, supply chain, logistics and operations management at McGill University, Canada.

People around the world are anxious to travel again as pandemic restrictions are being lifted. But those planning to jump on a plane for a vacation have been frustrated by chaos in the airline industry. In both North America and Europe, thousands of flights have been cancelled and hundreds of thousands of passengers have had their trips disrupted.

Here are answers to some key questions about the current problems with air travel.

Why are so many flights being cancelled or delayed?

The principal cause of the disruptions has been a shortage of qualified personnel at airports to handle the recent surge in passenger traffic.

Airlines have been taking advantage of recent demand for air travel by returning aircraft and flight schedules to close to 80% of pre-pandemic levels, with the resulting volume of flights putting significant stress on the capability of the supporting infrastructure — airports, air traffic control and labour conditions.

Are the problems only happening in certain airports or is this a worldwide issue?

The congestion phenomenon in the summer 2022 travel season is rapidly spreading across a number of European and North American airports. The reason behind this concentration of congestion is quite simple: these are the air travel markets that have experienced the highest volumes of air travellers in recent months.

The rapid elimination of Covid-19 protocols in these markets since March have generated a significant increase in the demand for air travel, with volumes of passengers that haven’t been seen in more than two years. This increase in volume has been highly evidenced in major airline hub airports such as Amsterdam, London, New York and Toronto, where tens of thousands of passengers are processed every day.

Are all the problems related to the pandemic?

When the global air travel market collapsed in March 2020 with the introduction of travel restrictions and border closures, the commercial aviation industry took steps to conserve cash and maintain a minimal workforce.

Hundreds of thousands of aviation workers were laid off or terminated, with years of experience and technical expertise removed from the ranks of the commercial aviation communities.

With the assistance of governments throughout the world, over US$200bn of financial support was provided by governments to help the commercial aviation industry maintain minimal service and prevent financial collapse.

When demand for air travel returned this March, the hiring frenzy began, but in a very different labour environment. The people who left in 2020 had, for the most part, moved on to other career opportunities and no longer had much interest in returning to an industry characterised by lower compensation and a higher employment risk. So the staff shortages have their genesis in the pandemic, and will continue to impact employment levels as travel returns.

How many more people are travelling these days compared to a year ago – and compared to pre-pandemic levels?

The International Air Transport Association publishes air travel statistics relating to the volume of air travel throughout various world markets. It has noted that there is a significant difference in the volume of air travel, when compared to both 2021 and pre-pandemic levels.

The air travel market that has demonstrated the highest rebound has been domestic North America — travel for April 2022 has increased more than 280 per cent compared to April 2021 traffic levels, but remains at slightly more than 30% lower than April 2019 levels.

In the Chinese domestic market, continuing pandemic-related travel restrictions and occasional city lockdowns have resulted in traffic levels down by close to 80% in April 2022, compared to April 2021 and 2019.

What can be done to prevent delays?

There are a number of perspectives that can be applied to a resolution of the current level of delays.

European authorities have announced specific reductions in flights, while the U.S. government is threatening to impose flight reductions as a means of minimising flight cancellations.

The Canadian government has facilitated a meeting with the major aviation organizations in Canada to discuss a concerted and effective resolution and Air Canada announced measures it was intending to implement to ease congestion at both Toronto Pearson and Montreal Trudeau airports.

Canadian government officials have also announced plans to hire close to 2,000 additional border security and screening personnel to deal with specific congestion issues. Labour groups are not certain that the problems of congestion will be addressed by such actions.

The main issue is the volume of air travellers that are being drawn into the airport environment by the volume of flights operated by the airlines. Airlines have decided to grow their capacity to meet surging air travel demand, but the airport infrastructure is not equipped to handle such volumes.

While such enthusiasm by the airline industry is laudable in times where adequate and experienced staff are available at airports, that is not the case now — and will not be the case for the foreseeable future.

How long will this last?

The summer travel season is in full flight in the northern hemisphere. Additional airline capacity and greater demand for air service by a travel-starved population will continue through at least September.

Unless actions being contemplated by American, European and Canadian carriers results in a reduction of peak loading of aircraft movements across major airline hubs, in North America and Western Europe primarily, the congestion and delays will continue – and possibly worsen.

Relief will most likely come in the fall, as demand for air travel is reduced with the arrival of the school season. Staffing will also reach required levels by the fall, with the arrival of normal commercial air operating conditions.

Other issues that may reduce demand include higher airfares due to inflation and higher oil prices, which may impact the survival of some airlines.

What advice would you give to air travellers over the next few months?

Airport authorities have been providing guidance to travellers on how best to prepare themselves for summer travel, including tips on how to avoid delays at security checks.

In this coming summer of disruption, I would recommend travellers embark on their air journey with patience, ensure they are well-rested prior to departing for the airport and remember that airline staff are also experiencing stressful moments during their day.

A smile, a thank you and, above all, a caring attitude for fellow travellers and staff is called for. The air travel experience will get better!
